Lincoln University Data@Lincoln Deposit Licence

Contributors to Data@Lincoln are asked to approve a licence agreement that signifies that they own the copyright and have the right to deposit the dataset(s). This grants Data@Lincoln and Lincoln University a LIMITED, NON-EXCLUSIVE LICENCE to disseminate the item through Data@Lincoln and to migrate the item (i.e. copy it) for preservation purposes.

The text of the licence is:

By granting this licence to Data@Lincoln, you (the author(s), copyright owner(s) or assignee(s)) agree to the following:

1. that you are the author (or listed author), copyright holder or assignee and have authority to make this agreement, and give Data@Lincoln the right to publish the dataset(s) in a digital archive or repository
2. that the dataset(s) is original and does not, to the best of your knowledge, infringe upon anyone else’s intellectual property
3. that, where third party copyright material appears in your dataset(s), you (or the lead author) have acknowledged the original author or copyright holder, and/or sought permission to include the third party material as part of this data
4. that, if the dataset(s) has been generated in the course of research that has been supported or sponsored by an agency other than Lincoln University, you represent that you have fulfilled any right or review or other obligations required by such contract or agreement, and that publication of the dataset(s) is not prohibited by such contract or agreement.

PERMISSIONS GIVEN TO DATA@LINCOLN 

Data@Lincoln shall distribute electronic copies of the dataset(s) for the lifetime of the repository. The lifetime of Data@Lincoln shall be deemed to include any new computer system used in the future that replaces the current system.

INTELLECTUAL PROPERTY

By granting this licence to Data@Lincoln, you agree to Lincoln University’s Intellectual Property Policy.

ANIMAL AND HUMAN ETHICS

By submitting your data to Data@Lincoln, you verify that you have sought and received the necessary Animal and/or Human Ethics approval to conduct your research. Upon discovery that this has not occurred, your dataset(s) can be withdrawn from Data@Lincoln should the Administrator decide this is warranted.

DEPOSITOR'S RIGHTS

Rights granted to Data@Lincoln through this agreement are non-exclusive. You are free to publish the dataset(s) elsewhere and no ownership is assumed by the repository when storing an electronic version of the dataset(s). Data@Lincoln will not make any alteration to your work.

WITHDRAWAL FROM DATA@LINCOLN 

The Administrator of Data@Lincoln reserves the right to remove the dataset(s) for any professional, administrative or legal reason. Any request for removal of the dataset(s) should be made to the Administrator. A metadata record indicating the dataset(s) was stored in the repository will remain visible in perpetuity.

DISCLAIMER

While every care will be taken to preserve the electronic copy of the dataset(s), Data@Lincoln is not liable for loss or damage while it is stored in the archive.
